Malawi Supreme Court of Appeal (MSCA) has set Monday, February 13 for hearing of an application in which the State wants the interdiction of Anti-Corruption Bureau director general Martha Chizuma restored.
High Court and MSCA registrar Kondwani Banda and one of the private practice lawyers representing the Attorney General in the matter, George Jivason Kadzipatike, confirmed the development on Friday.
Ironically, Malawi Law Society (MLS), honorary secretary Chrispin Ngunde, whose institution obtained an order against the interdiction of Chizuma, said he was not aware of the same.

In a brief interview, Kadzipatike said the matter will come before Justice of Appeal John Katsala.
Said Kadzipatike: “The case has been assigned to Justice Hon Katsala SC and he has directed that all parties should appear before him on Monday, February 13 2023 at 11am.
The decision to appeal to the Supreme Court follows a decision by Justice Mike Tembo of the High Court, Blantyre Registry, to reject an urgent application by lawyers representing the AG to restore the interdiction.
That application came after the same court on February 6, granted MLS an order pending a judicial review of the decision to suspend Chizuma on January 31 2023, until her criminal defamation case is concluded.
In the case, Kadzipatike and Chancy Gondwe, who are representing the AG, among other issues, argue that MLS lacks locus standi, has misread her objectives, that its conduct does not protect nor assist the public, but also that the order for permission to apply for judicial review was wrongly granted.
