The Mzuzu Child Magistrates court on Monday, rejected a bail plea of Mzuzu Mayor, Gift Desire Nyirenda arrested in a defilement case.
This means Nyirenda will remain in custody for four more nights waiting for the bail ruling.
Senior resident magistrate Felix Kamtsalira has since set 19th August for ruling saying bail is not the interest of justice for now.
In a fully packed court, Kamtsaira said although the defense has come up with some personal principles to be considered but everyone should understand about the nature of bail
In his submissions counsel for the accused, Davie Lameck asked the court to grant Nyirenda bail because he is not a flight risk and that has a family which makes him responsible not to jump bail.
Lameck further said his client is a well-known person and there are no witnesses.
“The person has very serious relationship to the community where he stays that means he cannot jump bail if bail is granted.
We are also looking at the circumstances surrounding the commission of the alleged offense, when you look at the offense of what he is being charged, it’s an offense for which bail can be charged of. At this stage he must be treated with the innocence until proven otherwise by the honorable court,” he said.
According to Lameck, his client’s case has been tried in the media in various ways.
Meanwhile, police prosecutors Moja Phiri and Fancy Sichali asked more time to investigate the case in order to produce witnesses arguing that since the case happened there have been no much time to investigate.
