Form 2 Student Earns 7-Year Jail Term For Raping A Mentally Challenged In Mchinji

The Mchinji First Grade Magistrate Court has today August 30, 2023 sentenced and convicted a 20 year old Tobiyasi Moyenda Mbewe a form 2 student at Ludzi Community Day Secondary School to 7 years imprisonment for engaging in sexual intercourse with a mentally challenged standard 6 primary school pupil on December 24, 2022.

According to the state prosecutor Sub Inspector Makhumbo Nkhoma, the convict told the Victim to follow him to his house where he coaxed her with sweets and forcefully had carnal knowledge of her.

The victim is said to have missed her monthly period and a pregnancy test at Ludzi Hospital revealed that she was pregnant.

Her guardians reported the matter to the police and the culprit was immediately arrested.

Tobiyasi Moyenda Mbewe voluntarily pleaded guilty to his own charge of having sexual intercourse with an embacile contrary to section 139 of the penal code.

The convict prayed for mercy, citing that he is a student but First Grade Magistrate Yohane Nkhata sentences him to 7 years in prison to deter other would-be offenders.

Tobiyasi Moyenda Mbewe hails from Chipiringu Village, Traditional Authority zulu in Mchinji district.
