Court slaps state on face in Chisa Mbele’s defamation case

Supreme Court of Appeal Justice Ivy Kamange has thrown out State’s application to stay High Court’s ruling that referred to the Constitutional Court Joshua Chisa Mbele’s criminal defamation case.

In her ruling delivered this afternoon in chamber in Lilongwe, Justice Kamanga has described the application as baseless, vexatious, frivolous and lacking merit.

In an interview, Chisa Mbele’s lawyer Gilbert Khonyongwa said the ruling means certification of the matter by the Chief Justice as a constitutional case will proceed.

Mbele is accused of defaming the Army Commander Vincent Nundwe.
