Court denies bail application by a rape suspect in Chikwawa

Resident Magistrate court in Chikwawa has denied bail application by Alfred Nkandala who is answering the charge of Sexual intercourse with minor contrary to section 138 subsection (1) of the penal code .

Nkandala who is a health surveillance assistance at Kakoma health centre asked the court to consider him a bail as he has wife and children whom he is bread winner , and so that he is also a civil servant hence he can not run away.

But responding to bail application , state prosecutor Superintendent Ian Mtaba objected the bail application .

Mtaba observed that the suspect is well educated and knows the consequences of the outcome it can be if found guilty hence he can run away.

Mtaba added that the state will quickly invite all four witnesses three of them being civil servants to make sure that justice has been delivered in time , hence asked the court not to grant the bail.

Senior resident Magistrate Byson Masonda agreed with the state by citing that the case the suspect is answering has national interest and that the judgement goes by confirmation by high court there fore he denied the bail to the suspect.

The case has been adjourned to 20 November.

Alfred Nkanda comes from Brighton Village , Traditional Mbenje in Nsanje.

Nkanda is reported to have committed the offense on 28 and 29 October to a 16 year girl who is a learner at Kakoma CDSS.
