CFTC mum on a move to challenge court ruling favouring Airtel on MK2.1 billion case

The Competition and Fair Trading Commission (CFTC) has said it is reviewing a High Court determination which has overturned the commission’s order for Airtel Malawi to pay K2.1 billion over unfair trading.

The commission’ spokesperson, Innocent Helema said they will see on whether to appeal or not after the review, adding that the court’s determination affects the core administrative mandate of issuing fines over unfair trading practices.

On Wednesday, High court judge Allan Muhome ordered the Commission to refund the fine to Airtel Malawi within 14 days, arguing despite the investigations which found the telecommunications company to be on the wrong side of the law, CFTC does not have powers to issue fines.
