Court adjourns ruling on Magalasi case

The Lilongwe Senior Resident Magistrate’s Court has adjourned to a later date a ruling on whether former Malawi Energy Regulatory Authority (Mera) chief executive officer Collins Magalasi has a case to answer in the Democratic Progressive Party (DPP) funding case.

Magalasi is accused of sourcing K10.5 million from Mera to pay for accommodation of DPP delegates at the party’s 2018 convention in Blantyre.

The court was on Thursday supposed to make a ruling of case or no case to answer after the State concluded submissions on July 21 2022.

However, the court failed to sit and the matter has since been adjourned to a date to be set by the court.

In an interview on Thursday, Magalasi’s lawyer Andy Kaonga said he was yet to establish the reason for the adjournment.

He said a date for the next sitting has not been set yet.

“The court will give a date for the ruling. We will wait for the date,” said Kaonga.

Director of Public Prosecutions Steve Kayuni said there was a slight delay in submissions for a case or no case to answer, which delayed the whole process.

“The court had earlier directed that the parties file submissions but there was a delay in filing. The court needed time to come up with the ruling,” he said.

On July 21, the court ordered the parties to file submissions of case or no case to answer within 14 days and the court would rule on the matter on August 18.

Magalasi is answering charges of alleged fraud and abuse of office. He denied both charges.

The State paraded seven witnesses to prove the two charges Magalasi is answering in the matter.
