The court in Ntcheu has found a Tsangano-based Business Man, Dzimadzi with no Case to answer following failure by the state to provide Tangible witnesses.
Dzimadzi was arrested in November following a Video Clip that went viral where Dzimadzi was Seen Beating up a young boy and he later threw him on the floor.
It is alleged that Dzimadzi suspected this boy to be one who was stealing his Irish Potatoes in the field and house.
The court also heard through the boy’s mother that the boy was accused of stealing 400 Kwacha and some undisclosed belongings from Dzimadzi’s vehicle.
In his ruling today, Senior Resident Magistrate Joshua Nkhono said the state has failed to prove that Dzimadzi intended to grievously harm the child.
According to Nkhono, the State failed to prove that what Dzimadzi did to this young boy was an act to cause grievous harm as the boy had only a few scratches hence the acquittal.
He thus says the court disagrees with state submissions hence the acquittal.
The video of Dzimadzi assaulting the child went viral on social media mainly WhatsApp.
Meanwhile, Social media users on platforms such as WhatsApp and Facebook are expressing mixed views following Dzimadzi’s acquittal with some suggesting that the clip was enough to lead to Dzimadzi’s conviction.
